Dreamgifts Membership Agreement

1. Parties

This Membership Agreement (“Agreement”) is made by and between Dreamgifts, the owner and operator of the website dreamgifts.tr (“Company”), and the real person or legal entity who becomes a member of the website (“Member”), and is deemed to have been concluded upon the Member’s electronic approval.

2. Subject of the Agreement

This Agreement sets forth the terms and conditions governing the Member’s use of the services provided via dreamgifts.tr, as well as the rights and obligations of the parties.

3. Membership and Terms of Use

3.1. Membership begins when the Member fills in the registration form with accurate and up-to-date information and the membership is approved by the Company.

3.2. The Member declares and undertakes that all information provided during registration is accurate and current, and accepts that any legal responsibility arising from such information being untrue or misleading shall rest solely with the Member.

3.3. The Company reserves the right to reject any membership application or suspend/terminate existing memberships at its sole discretion and without having to provide any reason.

3.4. The Member agrees and undertakes to use the website only for lawful purposes and in accordance with morality and principles of good faith, and not to infringe upon the rights of third parties or the Company.

4. Rights and Obligations of the Member

4.1. The Member is solely responsible for keeping their username and password used on the website confidential. The Company cannot be held liable for any damages arising from the sharing of such information with third parties.

4.2. The Member accepts that they are personally responsible for all transactions carried out through their account and that they will immediately notify the Company in the event of any unauthorized use of their account or any security breach.

4.3. In purchases made via the website, the Member accepts that the Distance Sales Agreement, Pre-Information Form, Cancellation and Refund Conditions, PDPL (KVKK) Information Notice and other policy texts are binding on them.

4.4. The Member accepts that deliveries such as e-vouchers, gift cards and booking confirmations will be made via e-mail, SMS or through the user panel, and therefore is responsible for the accuracy of their contact information.

4.5. The Member accepts that they will not spread viruses, trojans or other malicious software while using the website; will not engage in spam activities; and will not attempt any unauthorized access to the system.

5. Rights and Obligations of the Company

5.1. The Company may change, temporarily suspend or permanently discontinue the services and content offered on the website at any time.

5.2. The Company processes, stores and protects the Member’s personal data in accordance with the provisions of the Law No. 6698 on the Protection of Personal Data (“KVKK/PDPL”) and the relevant legislation.

5.3. The Company has the right to temporarily or permanently suspend access to the website due to technical reasons or maintenance works, and cannot be held liable for access problems arising therefrom.

5.4. In cases where the Member’s use of the website is contrary to the applicable legislation or this Agreement, the Company may immediately suspend or terminate the Member’s account.

6. Scope of Services

6.1. Dreamgifts.tr primarily offers services such as experience vouchers, gift cards, tour and activity reservations and similar services, which are mainly delivered in digital form.

6.2. The Member accepts that a separate Distance Sales Agreement is concluded for each product/service purchased via the website.

6.3. The delivery of experience vouchers and gift cards may be carried out by e-mail, SMS, PDF voucher or through the user account, as specified at the time of order.

6.4. The Member accepts that the usage conditions, validity period, date change rules and cancellation policies of the purchased experience vouchers, gift cards and other services are separately specified in the product descriptions.

7. Intellectual Property Rights

7.1. All designs, logos, visuals, texts, software codes, databases and all similar content on the website are owned by Dreamgifts or third parties from whom it has obtained licenses.

7.2. The Member may not reproduce, copy, distribute, share, use for commercial purposes or create derivative works from such content without the prior written consent of the Company.

7.3. The website, in whole or in part, may not be published in any other medium without the Company’s explicit written consent.

8. Privacy and Protection of Personal Data

8.1. The Member accepts that details on the processing of their personal data are set out in the PDPL (KVKK) Information Notice, Privacy Policy and Cookie Policy, and that they have read these texts.

8.2. The Company processes the Member’s personal data only for the purposes of providing services, fulfilling legal obligations, conducting customer satisfaction activities and carrying out marketing activities for which consent has been given.

8.3. Within the scope of the PDPL, the Member may exercise their rights such as accessing their personal data, requesting correction or deletion thereof, or objecting to its processing by applying to the Company.

9. Termination of the Agreement

9.1. The Member may request the cancellation of their membership account at any time via the website or by applying to the Company.

9.2. The Company may immediately terminate or suspend the Member’s membership in the following cases:

Providing untrue or misleading information,
Use that is unlawful, in the nature of a cyber-attack or threatening system security,
Transactions giving rise to suspicion of fraud, fraudulent payment methods, chargeback and similar situations,
Behaviours that damage the Company’s commercial reputation or are in bad faith.

9.3. Termination of membership does not eliminate any rights and obligations arising from purchases made by the Member in the past; the relevant Distance Sales Agreements shall continue to remain in force.

10. Governing Law and Jurisdiction

10.1. This Agreement is governed by the laws of the Republic of Türkiye.

10.2. In the settlement of disputes arising from this Agreement, for Members who qualify as consumers, the Consumer Arbitration Committees and Consumer Courts located at the Member’s place of residence shall have jurisdiction; in all other cases, the Nevşehir Courts and Enforcement Offices shall have jurisdiction.

11. Enforcement

By creating a membership account on dreamgifts.tr, the Member declares that they have read, understood and expressly accepted all the provisions of this Agreement by approving it in electronic form.

This Agreement enters into force immediately upon the Member’s electronic approval.
